Bulletin 96-26 Member Alert

Brothers and Sisters,

Thank you to everyone who came out to the General Membership meeting and met the principles for the Ferrone Law Group.   For those who could not make it, here is who is now standing behind you.

UFLAC has retained Ferrone Law Group as the union’s general counsel. FLG serves as general counsel to approximately 150 firefighter, police, probation and corrections associations across California, from five offices between Oakland and San Diego. Public safety is all they do, and they have fought for public safety members at every level, from the interrogation room and the bargaining table all the way to the United States Supreme Court.

Here is what that means for you.

Discipline. FLG’s discipline team represents firefighters from the first notice of investigation through Skelly and the Board of Rights, and helps with reprimands, notices to correct, and written rebuttals. FLG attorneys overturn dozens of terminations and suspensions at hearing every year. FLG is also training UFLAC representatives to handle disciplinary interviews, with an attorney behind every one.

Critical incidents. An FLG attorney is on call 24 hours a day, 7 days a week for line-of-duty injuries and deaths, apparatus collisions, and other critical incidents.

Workers’ compensation. Workers’ comp is included and handled by FLG’s in-house attorneys, including cancer and heart presumption claims. FLG created and built its own workers’ compensation ADR Carve-Out Program for public safety, which decides presumptive cancer and heart claims within 45 days, half the time the Labor Code otherwise allows.

Your contract and your career. MOU enforcement, grievances, Employee Relations Board claims, fitness for duty and return to work, and LAFPP disability retirement. Most civil claims are handled on a contingency or fee-shifting basis, so members pay no attorney’s fees out of pocket. For criminal matters, the initial consultation is included, and representation is available at reduced member rates.

How to get help. If PSD contacts you, you are ordered to an interview, you are served with discipline, you are injured on duty, or you have a question about your rights at work, call the UFLAC office at (800) 252-8352 or complete the “Need a Rep” link in the Library>Member Docs. For a critical incident after hours, contact your UFLAC representative or any Executive Board member, who can reach the on-call attorney immediately. Members are not permitted to directly reach out to FLG without approval from an EB member.

Protect yourself. If you are ordered to an interview that could lead to discipline, you have the right to a representative. Ask for one, and do not go in alone. Before you write or submit any statement about an incident that may be under investigation, call UFLAC. Do not text, email, or post about it with coworkers or on social media. Call early, before the interview and before the paperwork.

In Solidarity,
UFLAC Executive Board
